Settlement for client injured at a water park in Spain

Mr TL was on holiday in Spain when he with friends on an inflatable raft came down a water slide which tipped him out at the bottom causing him to snap his head back on the bottom of the pool and suffer an ASIA D injury. Mr TL was repatriated from Spain to the UK for continued treatment.

A claim was brought against the operator of the Spanish water park as well as their Insurers’ on the basis the operator was inadequately insured. We ensured proceedings were issued in the UK prior to the Brexit Agreement to enable jurisdiction to remain in London. Liability was denied by both Defendants who provided evidence from their life guards which was disputed by our client and his companions. The matter was listed for a split trial on liability at the High Court but subsequently settled at a Joint Settlement Meeting.
